Terms & Conditions for Purchase
The offer we submit on your behalf will provide that:
- All fixtures and fittings together with any moveable items specified in the sales particulars will be included in the purchase price. In addition, if you specify that any further items are to be included in the purchase, we will specify for those also.
- The sellers will be responsible for any repairs to the building of which the property forms part instructed by them (or by a majority of the owners in the building) and for any Statutory Notices dated prior to the date the contract for the purchase becomes binding ("conclusion of missives").
- Local authority consents (for example planning permission or building warrant/completion certificate will be checked to ensure the appropriate documentation is in place for any alterations pointed out by the surveyor as requiring approval.
- The sellers confirm they are not aware of any dry rot, wet rot, woodworm or rising or penetrating damp affecting the property or affecting the larger building and that guarantees and all necessary supporting documents are available for any treatment works carried out in the past.
- The sellers will insure the property up until the date of entry (when the keys are transferred to you) at which time you must ensure that the property and your possessions are adequately insured for reinstatement value.
- The central heating system (if any) and the gas (if present), plumbing and electrical systems any electrical item included in the sale are in reasonable working order commensurate with age, type or design. The seller will be responsible for any repairs required provided we intimate the defects in writing within seven days of the date of entry. You must therefore tell us of any problems as soon as possible to preserve your legal right of redress. You should not go ahead with any repairs (except in cases of emergency until we have given the sellers the opportunity to have the repairs carried out by their own tradesmen.
- The phone if connected to BT will remain connected up until the date of entry. You will require to arrange with BT to take over the line (otherwise they will disconnect it and a reconnection charge may be levied. If the line is connected to a cable operator this will normally be automatically cut off.
We will deal with all the technical matters relating to title and revert to you if we encounter any problem or if the sellers wish to modify any of the above conditions to our offer.
